Budget Overcharges Customers - check your final bill NOW!

Feldman Morgado has an ongoing investigation into the billing practices Budget Rent A Car for unfair billing without notification. Our investigation has determined that the Fuel Service Charge is automatically added to your bill despite the fact that you have agreed to fill up the gas tank prior to returning the vehicle and the fact you have refused the pre-paid Fuel Service Option. This billing practice may be in violation of Florida's Deceptive and Unfair Trade Practices Act ( FDUTPA), as well as federal regulations under The Federal Trade Commission Act ( FTCA).

Contact Lens Recall Moved to Class I by FDA

On October 13, 2011, CooperVision announced that they have expanded their worldwide recall of Avaira® Toric contact lenses. Originally initiated on August 19, 2011, CooperVision's recall is now an FDA Class I recall. Customers wearing Avaira Toric CooperVision soft contact lenses have suffered from silicone residue on the lenses which could cause hazy vision, discomfort, or eye injuries.

According to CooperVision's press release, "If you wear Avaira Toric contact lenses and experience any symptoms, CooperVision recommends that you stop wearing the lenses immediately. Contact your eye care practitioner for advice." Approximately 778,301 lenses were distributed according to the FDA. The recalled products were contaminated with the unintended presence of a silicone oil residue on lenses. The symptoms may range from hazy, blurry vision, discomfort to eye injuries requiring medical treatment.

According to the FDA's Medical Device Recall for AVAIRA Toric (enfilcon A) TORIC soft (Hydrophilic) Contact Lenses, 6 Soft Contact Lenses for Astigmatism, this is a Class I recall. "Class I recalls are the most serious type of recall and involve situations in which there is a reasonable probability that use of these products will cause serious adverse health consequences or death."

PRODUCTS LIABILITY CASE: PREMPRO: DEFECTIVE DRUG WITH RISK OF BREAST CANCER

We have commenced filing a lawsuit again the manufacturer of PREMPRO and are preparing a class action. According to the complaint, the manufacturers Wyeth and Pfizer failed to warn of the risks of breast cancer and knew their product was defective. Recently in November 2009 an Illinois jury awarded a Plaintiff $75 million dollars. Later, in February 2010, a jury in Philadelphia awarded a plaintiff a $9 million dollar award. Prempro was linked by a study in 2002 called the Women's Health Initiative that suggested the increased risk of breast cancer for Prempro.

CLASS ACTION FOR SINGULAIR SIDE AFFECTS

The firm is in the process of preparing a class action products liability lawsuit against the manufacturer (MERCK & Co Inc.) of Singulair for failure to warn and for strict liability related to the FDA’s 2009 investigation linking Singulair to such psychiatric side affects as depression and attempted suicide attempts in minors. As per the warnings by manufacturers of Singulair:

Neuropsychiatric events have been reported in adult, adolescent, and pediatric patients taking SINGULAIR. Post-marketing reports with SINGULAIR use include agitation, aggressive behavior or hostility, anxiousness, depression, dream abnormalities, hallucinations, insomnia, irritability, restlessness, somnambulism, suicidal thinking and behavior (including suicide), and tremor. The clinical details of some post-marketing reports involving SINGULAIR appear consistent with a drug-induced effect.

Patients and prescribers should be alert for neuropsychiatric events. Patients should be instructed to notify their prescriber if these changes occur. Prescribers should carefully evaluate the risks and benefits of continuing treatment with SINGULAIR if such events occur (see ADVERSE REACTIONS, Post-Marketing Experience)

Blood and lymphatic system disorders: increased bleeding tendency

Immune system disorders: hypersensitivity reactions including anaphylaxis, very rarely hepatic eosinophilic infiltration

Psychiatric disorders: agitation including aggressive behavior or hostility, anxiousness, depression, dream abnormalities, hallucinations, insomnia, irritability, restlessness, somnambulism, suicidal thinking and behavior (including suicide), tremor (see PRECAUTIONS, Neuropsychiatric Events)

Patient medicine guides state the following are potential side affects:

Behavior and mood-related changes have been reported: agitation including aggressive behavior or hostility, bad/vivid dreams, depression, feeling anxious, hallucinations (seeing things that are not there), irritability, restlessness, sleep walking, suicidal thoughts and actions (including suicide), tremor, trouble sleeping. Tell your doctor if you experience behavior or mood-related changes while taking SINGULAIR.
