What are the Statute of Limitations associated with the Products Liability?
Content: In death cases involving dangerous drugs such as Procrit or ESA's, generally you have 2 years under most states to pursue any claim of wrongful death. So if you have a loved one who has died following a hospital stay, a loss of blood, and has unexpectedly died then that's the timeframe to start looking at causes of action and in the 2 year period of time would generally run from the date of that person's death to the present. However, in instances such as Procrit, where the FDA came out with Black Box Warning changes in February of 2010, arguably we have 2 years from the date of the FDA warning which in this case, Procrit or the ESA's February of 2010 so you would have until February of 2012.
